In the case of S v Dlamini 1991 (2) SACR 655 (at 661i-667a) Nicholas AJA observed
that ‘whereas criminal trials in both England and South Africa are conducted up to
the stage of conviction with scrupulous, time-consuming care, the procedure at the
sentencing stage is almost perfunctory.' The Supreme Court of Appeal, some 20

REVISITING ALICE IN THE DEBTORS COURT: FAILING TO APPEAR IN COURT IN TERMS OF SECTION 65 A (9) ACT 32 OF 1944
Many magistrates seem to be under the impression there is no difference between Section 72 (4) of Act 51 of 1977(or Section 55(2) or similar sections) (Criminal Procedure Act) and Section 65 A (9) of Act 32 of 1944 (Magistrates Court Act). Both these provisions deal with a person’s failure to appear in court, the first in the Criminal Court and the latter in the Civil Court. The failure to distinguish between these provisions inevitably leads to debtors in the Civil Court being convicted in circumstances where they should have been acquitted.

S112 of the Criminal Procedure Act and questions from the bench A guilty plea by an accused person generally indicates that there is no issue between him and the state and that he admits all the allegations in the charge made against him. Section 112 of the CPA lays down procedure to be followed where an accused pleads guilty and the prosecutor accepts the plea. It has the interest of the accused at its core, with its requirement of questioning from the bench. It is designed to safeguard against incorrect pleas of guilty and the undesirable consequences thereof. S112 contains procedures which are designed to determine whether a plea of guilty has been properly tendered.
